Spain’s Supreme Court has set a groundbreaking legal precedent by ruling that a non-consensual kiss constitutes sexual assault. The ruling, which stemmed from a case involving a police officer kissing a woman in custody, clarifies that the absence of an explicit “no” from the victim does not negate the crime if consent was not given.
The ruling comes just months before former football federation chief, Luis Rubiales, will stand trial for his unsolicited kiss of Spanish footballer, Jenni Hermoso, during a medal ceremony.
