Hunter Biden’s arguments seeking to dismiss the federal firearms charge against him are “meritless” and should be denied, Special Counsel David Weiss said in a series of court filings on Tuesday.
In briefs with the U.S. District Court in Delaware, Weiss urged U.S. District Judge Maryellen Noreika to dismiss motions filed by Hunter Biden in December on various grounds, including a claim that he is the subject of selective and vindictive prosecution.
The federal firearms charges are among a series of legal challenges for President Joe Biden’s 53-year-old son.
Biden agreed to plead guilty to two counts of willful failure to pay federal income tax while avoiding prosecution for a single firearms charge if he met certain pre-trial conditions. However, that deal fell apart under questioning by Noreika at a hearing in July.
After the plea deal fell apart, Biden was indicted on three federal gun counts last September in Delaware, and on nine counts of felony and misdemeanor tax charges in December in California. A federal trial in Los Angeles is scheduled to begin June 20.
The president’s son has pleaded not guilty to all charges in both cases.
